Roofing contracts NZ: deposits, payments and variations explained

For residential building work costing $30,000 or more including GST, a written contract is mandatory. Below that threshold, a written contract is still sensible. The useful roofing contract is not just a price: it identifies the work, products, start/completion expectations, payment process, defects, dispute process and how variations are agreed before extra work proceeds. When is a written building contract mandatory?

MBIE says a written contract is mandatory when a homeowner contracts directly for residential building work costing $30,000 or more including GST. At that threshold, or if the homeowner asks, the contractor must also provide the prescribed consumer checklist and disclosure statement before signing. What should a roofing contract actually say?

  • Who the contracting parties are and the project address.
  • Expected start/completion dates and how delays are handled.
  • Price or the method used to calculate it.
  • The roofing work, products/materials and known inclusions.
  • Who handles any required consents or approvals.
  • Who carries out and supervises the work.
  • Payment stages and invoice process.
  • How defects are remedied.
  • How disputes are handled.
  • How variations are agreed before changed work continues.

These are not RoofHub-invented clauses: they reflect the minimum-content themes in MBIE residential building-contract guidance. A particular project may need legal advice or additional terms. Sources: Building Performance.

How much deposit should you pay a roofer?

Consumer Protection states there is no legal requirement to pay a deposit merely because you accept a quote. If a deposit is requested, its published consumer guidance says not to pay more than 10% of the total cost. The rest of the payment structure should still make sense against materials supplied and work completed. Sources: Consumer Protection.

A project may have legitimate reasons for staged payments or material commitments. The important point is to put the payment schedule in the contract and understand what each payment corresponds to rather than paying an unexplained large amount in advance. Can a roofing quote change?

Quote, estimate and variation
TermPractical meaning
Fixed quoteConsumer Protection says the provider should complete the agreed work for the quoted price unless you agree to a variation. Sources: Consumer Protection.
EstimateA best estimate is not the same as a fixed quote; significant changes should be explained and not deliberately understated. Sources: Consumer Protection; Commerce Commission.
VariationA change to contracted work. Put scope, price and timing consequences in writing before the changed work proceeds where practicable. Sources: Building Performance; Building Performance.

What should progress payments be tied to?

MBIE guidance says contracts should describe the payment process and can set out the number, amount and due date of payments. If the contract does not provide a payment schedule, statutory default provisions may apply. Sources: Building Performance; Building Performance.

  • Match stages to identifiable work or supplied materials.
  • Keep invoices and payment records.
  • Do not assume the final payment means warranty or completion documents no longer matter.
  • If there is a payment dispute, follow the contract and Construction Contracts Act process rather than improvising.

Before signing a roofing contract

  • Compare the final written scope against the quote you accepted.
  • Check product/profile/coating and major flashings rather than only a brand name.
  • Confirm removal, scaffold/access, underlay, disposal, drainage and known repairs.
  • Read the payment and variation clauses.
  • Check who is responsible for consent and LBP documentation if relevant.
  • Save the disclosure statement, contract and any later written variations.

Related questions

Do I legally need a written contract for a $25,000 reroof?

The statutory written-contract threshold is $30,000 or more including GST for residential building work contracted directly with a homeowner. MBIE recommends written contracts below that threshold as well. Sources: Building Performance; Building Performance.

Can a roofer ask for more money than the quote?

A fixed quote should cover the agreed work unless you agree to a variation. Legitimate changed or additional work should be identified and agreed rather than simply added without explanation. Sources: Consumer Protection; Building Performance.

Is a 50% roofing deposit normal in New Zealand?

RoofHub does not treat a large deposit as automatically fraudulent, but Consumer Protection says there is no legal requirement to pay a deposit on accepting a quote and advises not paying more than 10% of the total cost if one is requested. Sources: Consumer Protection.

Estimate it, refine it, or ask RoofHub.

Start with approximate information, use actual measurements when you have them, or ask RoofHub to explain the decision. A roofing contractor still needs to confirm the site, specification and final quotation.
